Landmark ruling says plaintiff can sue for pre-birth injuries

A report from LifeNews.com on February 27, 2007, says that a New York state appeals court ruled that a girl is allowed to sue the city of Brooklyn for birth injuries that originated before she was born.

Pro-life advocates are hailing this decision as a milestone in furthering the rights of unborn children. The case itself involved a girl whose mother worked for the city of Brooklyn while pregnant with her and had a public toilet collapse, causing injuries to the unborn girl in January 1999.

The mother's placenta ruptured and eventually caused premature birth that included physical and mental disabilities.

The court handed down a strong ruling saying that any unborn child has the right to have a lawsuit filed on their behalf as long as injuries occurred after conception and the child was born alive.
